This page sets out the right of withdrawal applied by DOM di Domenico De Vivo (DOM vintage wholesale) to purchases made on domshop.it, under articles 52 to 59 of the Italian Consumer Code (Legislative Decree 206/2005) and under the new article 54-bis, in force from 19 June 2026.
The online withdrawal function
From 19 June 2026, article 54-bis of the Italian Consumer Code, introduced to implement Directive (EU) 2023/2673, requires that for contracts concluded through an online interface the right of withdrawal can be exercised through a dedicated digital function, clearly visible and easily accessible, available for the whole of the withdrawal period.
On domshop.it that function is on the page of each order, inside the My account area, labelled Withdraw from the contract. There is no need to telephone, to send a registered letter or to fill in a PDF.
The declaration sent through that function contains the consumer's name, the details of the order and of the products the withdrawal refers to, and the electronic address at which to receive confirmation.
Immediately afterwards we send, without undue delay, an acknowledgement of receipt on a durable medium: an email reporting the content of the declaration received, together with the exact date and time of transmission. That email is the proof that withdrawal was exercised and should be kept.
The traditional methods described below remain valid as an alternative.
Who is entitled to withdraw
The right of withdrawal belongs to the consumer, that is the natural person purchasing for purposes outside any trade, business, craft or profession.
Anyone purchasing under a VAT number, or requesting an invoice as a business, is making a business to business purchase: in that case the right of withdrawal provided by the Italian Consumer Code does not apply. The legal guarantee against defects and the terms agreed for the individual order remain unaffected.
Time limit
The consumer has fourteen days to withdraw from the contract, without giving any reason and without penalty.
The period runs from the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.
Where the order comprises several goods delivered separately, the period runs from the delivery of the last item. Where an item consists of several lots or pieces delivered separately, the period runs from the delivery of the last lot or piece.
If the seller fails to inform the consumer of the right of withdrawal, the period is extended by twelve months from the end of the initial period.
The other accepted methods
Besides the online function, withdrawal may be communicated:
- by completing the model withdrawal form set out below and sending it to info@domshop.it;
- by any other explicit and unequivocal statement of the decision to withdraw, sent to the same address or by post to DOM di Domenico De Vivo, Via Lavinaio I Tratto 12, 80044 Ottaviano (NA), Italy.
To meet the deadline it is enough that the communication is sent before the fourteen days expire. The burden of proving that withdrawal was exercised lies with the consumer: the online function discharges it on its own, because it produces the acknowledgement of receipt with date and time.

Using the form is not compulsory. Anyone who prefers to use it may copy the text below (Annex I, part B, of the Italian Consumer Code):

Returning the goods
The goods must be sent back without undue delay and in any event within fourteen days from the day on which the withdrawal was communicated. The deadline is met if the goods are dispatched before it expires.
The direct cost of returning the goods is borne by the consumer, unless otherwise agreed in writing. Since these are bulky and heavy parcels, it is worth asking the courier for a quotation before shipping and agreeing the arrangements with us by writing to info@domshop.it.

Condition of the returned goods
The consumer may handle the goods with the same care as would be allowed in a physical shop. The consumer is nevertheless liable for any diminished value resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
For clothing boxes this means in practice: garments may be opened, examined and tried on, but not washed, altered, stripped of labels or tags, or used. Packaging material should be kept where possible.
If diminished value is established, the corresponding amount is withheld from the refund and the consumer receives a written breakdown of it.
Refund
The refund covers the price of the goods and the standard delivery costs paid with the order. If the consumer chose a delivery more expensive than the standard one, the difference remains at the consumer's expense.
The refund is made without undue delay and in any event within fourteen days of the day on which we are informed of the decision to withdraw, using the same means of payment as the order unless expressly agreed otherwise. In no case does the refund entail any cost for the consumer.
As the law allows, we may withhold the refund until we have received the goods back, or until the consumer supplies evidence of having sent them back, whichever is the earlier.
Where withdrawal is partial on an order made up of several boxes, the share corresponding to the returned goods alone is refunded.
Cases where withdrawal does not apply
Under article 59 of the Italian Consumer Code the right of withdrawal is excluded, among others, for:
- goods made to the consumer's specifications or clearly personalised: this covers boxes assembled by the customer with the "Build your box" configurator, once the selection has been put together and prepared on the customer's instructions;
- sealed goods which are not suitable for return for reasons of health protection or hygiene, if unsealed after delivery;
- goods which, after delivery, are by their nature inseparably mixed with other items.
Outside these cases the right of withdrawal remains fully exercisable.
Faulty or non-conforming goods
Withdrawal is not the same as the guarantee. If goods arrive damaged, incomplete or not matching the order, there is no need to wait or to justify a withdrawal: the legal guarantee of conformity applies, with a right to repair, replacement or a price reduction, and the costs are ours. On delivery it is worth checking the parcel in front of the courier: if the packaging is damaged, sign with reserve and report it the same day.
