These conditions govern distance selling on the DomShop store (DOM vintage wholesale).

The Italian version of these conditions is the authoritative one. This translation is provided for convenience; where the two differ, the Italian text prevails.

Subject of the contract

These conditions govern the distance selling of second-hand (used) products, including any "rework" or "custom" items, under Italian Legislative Decree 206/2005. The products sold are used goods that may show signs of wear and minor imperfections described in the product pages.

Conclusion of the contract

The contract is concluded when the order is confirmed and payment is received. The Seller reserves the right not to accept orders because of unavailability or other legitimate reasons.

Prices and payments

Prices are in euro and include VAT. Payments are accepted by:

  • debit, credit and prepaid cards (Stripe);
  • Klarna;
  • bank transfer.

The Seller does not store any data relating to payment instruments.

Shipping and delivery

Shipping is handled by a selected courier. Delivery times are indicative. The risk of loss or damage passes to the consumer upon delivery.

Right of withdrawal

The customer has the right to withdraw within 14 days of delivery under the Italian Consumer Code. Withdrawal may be exercised:

Return shipping costs are borne by the customer. The customer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

Exclusions from the right of withdrawal

Under art. 59 of the Italian Consumer Code, the right of withdrawal is excluded for:

  • goods made to measure or clearly personalised;
  • products modified or reworked at the customer's specific request.

"Rework" and "custom" items may fall within these exclusions.

Condition of second-hand products

The products are used goods and are sold as they are. The customer declares to be aware of the second-hand nature of the goods purchased.

Legal guarantee

The legal guarantee of conformity under the Italian Consumer Code applies. For used goods, its duration may be limited to one year.

Limitation of liability

The Seller is not liable for indirect damages, loss of profit or improper use. Liability is limited to the extent permitted by applicable law.

Retention of title

Ownership of the products passes only upon full payment of the price.

Applicable law and jurisdiction

The contract is governed by Italian law. For disputes with consumers, the court of the consumer's place of residence or domicile has jurisdiction.
