This page sets out the right of withdrawal applied by DOM di Domenico De Vivo (DOM vintage wholesale) to purchases made on domshop.it, under articles 52 to 59 of the Italian Consumer Code (Legislative Decree 206/2005) and under the new article 54-bis, in force from 19 June 2026. This is the page that prevails: the Terms and conditions summarise it, and the Returns and refunds page explains how to ship the return and how we check it.
The online withdrawal function
Since 19 June 2026, article 54-bis of the Consumer Code, which transposes Directive (EU) 2023/2673, requires that for contracts concluded through an online interface the right of withdrawal can be exercised through a dedicated digital function, clearly visible and easily accessible, available for the whole withdrawal period.
On domshop.it this function is on the page of each order, in the My account area, under the label Withdraw from the contract. No phone call, registered letter or PDF form is needed.
Customers who ordered without an account can create one with the same e-mail used for the order: once the e-mail is confirmed, the order appears in My account with the withdrawal function. Alternatively, they can use the other methods described below.
The declaration sent through that function contains the consumer's name, the details of the order and of the products the withdrawal refers to, and the e-mail address where the confirmation is to be received.
In the same function you must state the reason for the return and attach photos and videos of the goods: at least one photo and one video (up to 3 photos and one video).
Right after the submission we send, without undue delay, an acknowledgement of receipt on a durable medium: an e-mail that reproduces the content of the declaration received, with the exact date and time of transmission. That e-mail is the proof that the right of withdrawal has been exercised and should be kept.
Who has the right of withdrawal
The right of withdrawal belongs to the consumer, i.e. the natural person who buys for purposes outside any business, commercial, craft or professional activity they may carry out.
Anyone who buys stating a VAT number, or asks for an invoice as a professional, makes a business-to-business purchase: in that case the right of withdrawal under the Consumer Code does not apply. The warranty against defects and the conditions agreed in the individual order remain in force.
Any return request, from a consumer or with a VAT number, requires the reason and photos and videos of the goods, stated and attached from the order page. Without the reason, photos and videos the request is not processed. Based on the reason and the evidence, the right compromise will be found with the company DomShop.
Withdrawal period
The consumer has fourteen days to withdraw from the contract. Anyone withdrawing must state the reason and attach photos and videos of the goods.
The period starts on the day on which the consumer, or a third party indicated by the consumer other than the carrier, acquires physical possession of the goods.
If the order includes several goods delivered separately, the period starts from the delivery of the last item. If an item consists of several lots or pieces delivered separately, the period starts from the delivery of the last lot or piece.
If the trader fails to inform the consumer of the right of withdrawal, the period is extended by twelve months from the end of the initial period.
Other accepted methods
Besides the online function, the withdrawal can be notified:
- by filling in the model withdrawal form below and sending it to info@domshop.it;
- by any other explicit and unequivocal statement of the decision to withdraw, sent to the same address or by post to DOM di Domenico De Vivo, Via Lavinaio I Tratto 12, 80044 Ottaviano (NA), Italy, stating the order number.
To meet the deadline it is enough to send the communication before the fourteen days expire. The burden of proving that the right of withdrawal was exercised lies with the consumer: the online function meets it on its own, because it produces the acknowledgement of receipt with date and time.
Model withdrawal form
Using the form is not mandatory. If you prefer to use it, you can copy the following text (Annex I, part B, of the Consumer Code):

Returning the goods
The goods must be returned without undue delay and in any case within fourteen days of the day on which the withdrawal was notified. The deadline is met if the goods are sent back before it expires.
The direct cost of returning the goods is borne by the consumer. Since the parcels are bulky and heavy, it is worth asking the carrier for a quote before shipping.
The goods must be sent back to DOM di Domenico De Vivo, Via Lavinaio I Tratto 12, 80044 Ottaviano (NA), Italy. The original packaging is not required: any packaging that protects the goods in transit is fine. How to ship, in detail, is explained on the Returns and refunds page.
Condition of returned goods
The consumer may examine the goods with the same care as in a physical shop: items can be unpacked, examined and tried on. The consumer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
If, when we check the return, items are missing, or items have been washed, worn, stained or altered, we deduct the corresponding amount from the refund, according to the criteria published on the Returns and refunds page. The consumer receives the details of the deduction in writing, with photos.
Refund
The refund covers the price of the goods and the standard delivery costs paid with the order. If the consumer chose a more expensive delivery than the standard one, the difference remains at their expense.
The refund is made without undue delay and in any case within fourteen days of the day on which we were informed of the decision to withdraw, using the same means of payment as the order, unless expressly agreed otherwise. The refund is made in money and never involves any cost for the consumer.
As permitted by law, we may withhold the refund until we have received the goods or until the consumer has supplied evidence of having sent them back, whichever is earlier. The evidence of shipment is the carrier's receipt with the tracking number.
In the case of a partial withdrawal from an order made up of several boxes, the share corresponding to the returned goods only is refunded.
When the right of withdrawal does not apply
Under article 59 of the Consumer Code the right of withdrawal is excluded for goods made to the consumer's specifications or clearly personalised. On domshop.it these are:
- «rework» or «custom» items made or altered at the customer's specific request;
- boxes composed by the customer with the «Create your box» configurator, once the selection has been assembled and prepared on their instructions.
Outside these cases the right of withdrawal can be fully exercised.
Faulty or non-conforming product
Withdrawal is not the same as the warranty. If the goods arrive damaged, incomplete or different from what was ordered, there is no need to withdraw: the legal guarantee of conformity applies, with the right to repair, replacement or a price reduction, and the costs are borne by us. The duration of the guarantee is set out in the Terms and conditions.
Report it from the order page, in the Goods damaged, incomplete or different? box, or by writing to info@domshop.it. We ask you to help us with a photo or a video showing the problem and the packaging: it helps us solve it faster.
On delivery it is worth checking the parcel in front of the courier: if the packaging is damaged, sign with reservation and report it the same day.
